General Terms and Conditions of Sale (GTCS)

The present conditions of sale are concluded on the one hand by the company COMMERCIAL AND MANAGEMENT PUBLIGESTION GROUP, S.L. with registered office in Alcudia, registered in the Companies Register of the Balearic Islands under the number CIF B16582793 hereinafter referred to as "PUBLIGESTION and managing the website www.dropbydrop.net and, on the other hand, by any individual or legal entity wishing to make a purchase via the website www.dropbydrop.net, hereinafter referred to as "the buyer".

 

Article 1. Purpose

The present conditions of sale aim at defining the contractual relations between PUBLIGESTION and the purchaser and the conditions applicable to any purchase made by the means of the Internet site www.dropbydrop.net. The acquisition of a product through the present site implies an acceptance without reserve by the buyer of the present conditions of sale of which the buyer recognizes to have taken knowledge before his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site www.dropbydrop.net is not directly related to his professional activity and is limited to a strictly personal use and on the other hand to have the full legal capacity, allowing him to commit himself under these general conditions of sale.

The company PUBLIGESTION keeps the possibility of modifying at any time these conditions of sales, in order to respect any new regulation or with an aim of improving the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the buyer.

 

Article 2. Products

The products offered are those that appear on the site www.dropbydrop.net of the company PUBLIGESTION within the limits of available stocks. The company PUBLIGESTION reserves the right to modify at any time the range of products. Each product is presented on the website in the form of a description of its main technical characteristics (capacity, use, composition). The photographs are as accurate as possible but do not commit the Seller. The sale of products presented on the website www.dropbydrop.net is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

 

Article 3. Tariffs

The prices appearing on the product sheets of the internet catalogue are prices in Euros (€) including all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change of the rate of the VAT could be reflected on the price of products. The company PUBLIGESTION reserves the right to modify its prices at any time, being however understood that the price appearing in the catalog the day of the order will be the only applicable one to the buyer. The indicated prices do not include the expenses of delivery, charged in supplement of the price of the bought products according to the total amount of the order.

 

Article 4. Order and payment terms

Before placing an order, the buyer must create an account on the site www.dropbydrop.net . The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or to consult his account (state of the orders, profile), will have to identify himself with this information. The company PUBLIGESTION proposes to the purchaser to order and to pay his products in several stages, with 3 options of payment in the choice:

- Payment by bank transfer: the buyer selects the products he wishes to order in the "basket", checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the method of payment of his choice: "Payment by bank transfer". Finally, the last step proposes to verify all the information, to read and accept the present general conditions of sale by ticking the corresponding box, then invites the buyer to validate his order by clicking on the "Confirm my order" button. This last click constitutes the final conclusion of the contract. Upon validation, the buyer receives an order form confirming the registration of his order. In order to finalize his payment and to start the treatment of his order, the purchaser must contact his bank in order to make the transfer corresponding to the amount of his order towards the bank account of PUBLIGESTION whose coordinates are communicated to the purchaser. Upon receipt of the transfer, the order will be processed and the buyer will be informed by e-mail. The company PUBLIGESTION will send the products at the earliest 2 working days after reception of the transfer corresponding to the order, under reserve of provisions.

- Secure payment by Shopify Payments or credit card (via the Shopify Payments system): the buyer selects the products they wish to order in the "shopping cart", modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of their choice: "Payment by Shopify Payments ". In the next step, the buyer is asked to check all the information, to read and accept the present terms and conditions of sale by ticking the corresponding box, and then to confirm the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure Shopify Payments interface in order to enter their Shopify Payments account details or personal credit card details in complete security. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by Shopify Payments or credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand the cancellation of the card payment and the sums paid will be credited back or refunded. The responsibility of the bank card holder is not engaged if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or even 120 days if the contract binding him or her to the bank so provides. The amounts debited are reimbursed by the bank within a maximum of one month after receipt of the cardholder's written objection. The holder shall not be liable for any costs incurred in returning the sums.

The confirmation of an order implies acceptance of these terms of sale, the recognition of having perfect knowledge of them and the renunciation to take advantage of its own conditions of purchase. All the data provided and the recorded confirmation will be considered as proof of the transaction. If the purchaser has an electronic address and if he informed it on his order form, the company PUBLIGESTION will communicate him by electronic mail the confirmation of the recording of his order.

Secure payment with Amazon Pay: Amazon Pay is a service that allows the buyer to pay for products and services using the payment methods already associated with their Amazon account. To make a payment, the buyer can use any of the methods he or she has set up for their Amazon account.

Article 5. Reservation of ownership

The company PUBLIGESTION keeps the full and whole property of the sold products until the perfect collection of the price, in principal, expenses and taxes included.

 

Article 6. Withdrawal

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for return costs.

 

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Orders are made by La Poste via COLISSIMO, a delivery service with tracking, delivered without a signature. The delivery times are given only as an indication; if they exceed thirty days from the order, the sales contract may be terminated and the buyer refunded. The company PUBLIGESTION will be able to provide by e-mail to the purchaser the number of follow-up of his parcel. The purchaser is delivered to his residence by his factor. In case of absence of the purchaser, he will receive a notice of passage of his factor, which allows him to withdraw the ordered products in the nearest post office, during a period indicated by the postal services. The risks linked to the transport are in charge of the purchaser from the moment when the articles leave the premises of the company PUBLIGESTION. The purchaser is held to verify in the presence of the employee of the Post office or the deliverer, the state of the packing of the goods and its contents to the delivery. In case of damage during the transport, any protest must be made to the carrier within three days as from the delivery.

 

Article 8. Guarantee

All products supplied by the company PUBLIGESTION benefit from the legal guarantee provided by Articles 1641 and following of the Civil Code. In case of nonconformity of a sold product, it can be returned to the company PUBLIGESTION which will take it back, exchange it or refund it. All the complaints, requests for exchange or refunding must be carried out by post at the following address: COMMERCIAL AND MANAGEMENT PUBLIGESTION GROUP, S.L Teodoro Canet 28, 07400 Alcudia, Spainwithin thirty days after delivery.

 

Article 9. Liability

The company PUBLIGESTION, in the process of remote sale, is held only by an obligation of means. Its responsibility could not be committed for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of the service, or other involuntary problems.

 

Article 10. Intellectual Property

All the elements of the site www.dropbydrop.net are and remain the intellectual and exclusive property of the company PUBLIGESTION. Nobody is allowed to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site they are in the form of photo, logo, visual or text.

 

Article 11. Personal data

The company PUBLIGESTION makes a commitment to preserve the confidentiality of the information supplied by the purchaser, which he would be brought to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of 6 January 1978. As such, the Internet user has the right to access, modify and delete information concerning him. Article 12. Settlement of disputes

The present conditions of distance selling are subject to European law. For any dispute or litigation, the competent court will be the one of Palma de Mallorca in Spain.
